The Dream Design Studio provides services exclusively for business purposes.

These Terms & Conditions apply to Clients purchasing our services wholly or mainly for purposes relating to their trade, business, craft or profession.

By booking a project with The Dream Design Studio, the Client confirms that the services are being purchased for business purposes.

All projects are subject to availability. Where a specific project start date is provided, this date is only secured once the required payment has been received.

Any project date offered before payment is received is provisional and may remain available to other Clients. We cannot guarantee that a previously offered date will remain available if payment is made at a later time.

Completion times depend on the scope of the project, Client response times, amendments, approvals and the timely provision of all information and materials required to complete the project.

All information, content, imagery, wording, login details, inspiration and other materials requested by The Dream Design Studio must be supplied before the Client’s scheduled project start date.

It is the Client’s responsibility to ensure everything required to begin the project has been submitted on time.

If the required information has not been supplied before the scheduled start date and this prevents the project from beginning as planned or causes the project to begin late, the project will be moved to The Dream Design Studio’s next available project date and a rescheduling fee will apply.

The amount of the rescheduling fee will be determined by The Dream Design Studio at its discretion, taking into account the circumstances and disruption caused.

Unless otherwise agreed in writing, full payment is required upfront to secure a project and its scheduled start date.

Where third-party payment options such as Klarna or PayPal Pay in 3 are available, these are subject to the individual provider’s eligibility requirements and terms. The Dream Design Studio has no control over whether a Client is approved for a third-party payment option.

Any additional work requested outside the originally agreed scope may incur an additional charge. Any additional costs will be communicated to the Client before the additional work is undertaken.

All project bookings reserve dedicated time within The Dream Design Studio’s schedule and are based on the agreed scope of work.

If a Client chooses to cancel a project before work has commenced, any refund will be considered at The Dream Design Studio’s discretion, taking into account the reserved project time and any work, preparation or costs already incurred.

Once work has commenced, payments are non-refundable. This includes circumstances where the Client changes their mind, decides not to proceed with the project or no longer requires the completed work.

Where The Dream Design Studio is unable to fulfil a project, the Client will be contacted and an appropriate resolution, such as rescheduling or a refund for services not provided, will be arranged.

Nothing within these Terms excludes any rights or remedies which cannot lawfully be excluded.

Each project includes only the services, deliverables and specifications agreed at the time of booking.

Requests falling outside the original project scope may be quoted separately. This can include additional pages, concepts, designs, formats, functionality, copy, products or other work not included within the original booking.

The Client is responsible for checking the scope of their chosen service or package before booking and raising any questions before work begins.

By booking The Dream Design Studio, the Client acknowledges that they are commissioning the Studio based on its existing portfolio, creative style and professional expertise.

The Client’s ideas, inspiration, preferences and feedback will be considered throughout the project. However, The Dream Design Studio retains professional creative discretion when developing the work.

Amendments are intended to refine the agreed creative direction. A significant change of direction after work has commenced, including requests for substantially different concepts or a new brief, will not be considered a standard amendment and may require an additional fee.

Any additional fee will be communicated before the additional work is undertaken.

All projects include three rounds of amendments, unless otherwise agreed in writing.

Each round can include a complete list of changes and is not limited to one individual amendment. Clients are encouraged to review their design carefully and submit all requested changes together within each round.

For example, changing a colour, adjusting wording and repositioning an element can all be requested together within one amendment round.

Amendments are intended to refine the agreed design and creative direction rather than create an entirely new concept or substantially change the original brief.

Once all three included rounds have been used, further amendments may incur an additional charge. The cost will be confirmed before further work is carried out.

Changes requested after a design has been approved and finalised may also incur an additional fee.

Clients are expected to remain reasonably responsive while their project is active.

If the Client does not respond or provide required feedback, approval, information or materials for 14 consecutive days, the project will be considered inactive and may be archived.

Once archived, the project will not automatically resume when the Client returns. The project will need to be rebooked for The Dream Design Studio’s next available project date and a restart fee will apply.

The amount of the restart fee will be determined by The Dream Design Studio at its discretion, taking into account the project, work required to resume it and the circumstances surrounding the delay.

The Client is responsible for supplying accurate and final text, information, prices, contact details, imagery and any other content required for their project.

The Client must ensure that they have the necessary rights, licences and permissions to provide any logos, photographs, fonts, illustrations, copy or other materials supplied to The Dream Design Studio.

The Dream Design Studio will not be responsible for copyright infringement or other claims arising from materials supplied or specifically requested by the Client where the Client did not have the necessary permission to use them.

The Client is responsible for carefully checking all designs before giving final approval.

This includes, but is not limited to, spelling, grammar, wording, names, dates, prices, contact details, addresses, QR codes, social media handles and other factual information.

Once the Client has provided final approval, they accept responsibility for any errors that were visible within the approved artwork.

If reprinting or additional design work is required because of an error contained within Client-approved artwork, the associated costs will be the Client’s responsibility.

If an error is introduced by The Dream Design Studio after the Client has approved the artwork, we will take reasonable steps to correct the issue.

The final files supplied will depend on the service booked.

Editable, native, source or working files are not included unless explicitly stated as part of the service.

Fonts, stock imagery, graphics and other licensed assets remain subject to their respective third-party licence terms and cannot necessarily be transferred or supplied directly to the Client.

Where required, text or other elements may be outlined, rasterised, flattened or otherwise prepared so that the final artwork can be used without transferring a third-party licence.

Unless otherwise agreed in writing, The Dream Design Studio retains ownership of all concepts, drafts, unused designs, rejected concepts, development work and other creative material that does not form part of the final approved deliverables.

Once full payment has been received, the Client will receive the rights applicable to their final approved deliverables, subject to any third-party licensing restrictions.

Rejected, unused or unapproved concepts may not be used, copied, reproduced, modified or distributed by the Client without written permission from The Dream Design Studio.

The Client must not upload, submit or otherwise provide work created by The Dream Design Studio — including final designs, concepts, drafts, branding, logos, graphics, layouts or other creative material — to generative artificial intelligence systems for the purpose of recreating, imitating, modifying, extending or generating derivative works based on the Studio’s work.

The Client must not use The Dream Design Studio’s work as a prompt, reference, input, training material or source material for generating new designs that imitate or derive from the Studio’s creative work.

This restriction does not prevent the Client from using their final approved deliverables normally for their business in accordance with the rights granted to them under these Terms.

Website projects are based on the pages, functionality and scope agreed at the time of booking.

The Client is responsible for any ongoing third-party costs associated with their website unless explicitly stated otherwise. These may include website plans, domains, apps, plugins, booking systems, email services or other subscriptions.

Where a website relies on a third-party platform or service, The Dream Design Studio cannot be held responsible for outages, changes or loss of functionality caused by that third-party provider.

The Client is responsible for providing accurate content and ensuring that business-specific information, claims, policies and legal requirements are appropriate for their individual business.

Unless ongoing maintenance has been purchased or otherwise agreed, responsibility for the website passes to the Client following completion and handover.

Once a website has been approved and handed over, The Dream Design Studio is not responsible for issues caused by subsequent changes made by the Client or another third party.

This includes changes to layouts, content, settings, integrations, applications, functionality or other website elements.

If assistance is required to investigate or correct an issue caused by changes made following handover, this will be considered additional work and may be quoted separately.

The Client is responsible for carefully checking and approving all artwork before it is submitted for printing.

This includes spelling, wording, contact information, prices, dates, addresses, QR codes, positioning and any other information contained within the design.

Once artwork has been approved and entered production, changes or cancellations may no longer be possible.

Colours displayed digitally may vary from colours produced in physical print due to differences between screens, colour profiles, printing processes, materials, inks and finishes.

Reasonable variations in colour, positioning, trimming and finishing can occur during commercial printing and will not necessarily be considered a fault.

If reprinting is required because of an error that was visible within Client-approved artwork, the Client will be responsible for the associated reprinting and delivery costs.

The Client is responsible for supplying a complete and accurate delivery address.

The Dream Design Studio cannot be responsible for failed or delayed delivery resulting from an incorrect or incomplete address supplied by the Client.

Where an order must be resent because incorrect delivery information was provided, additional postage or delivery charges may apply.

Estimated print and delivery times are not guaranteed. The Dream Design Studio is not responsible for delays caused by printers, couriers, postal services or circumstances outside our reasonable control.

If printed goods arrive damaged, defective or materially different from the approved specification, the Client should contact The Dream Design Studio as soon as reasonably possible and provide photographs and any other information reasonably required to investigate the issue.

Any turnaround time provided is an estimate unless a specific completion deadline has explicitly been guaranteed in writing.

A booked project start date is not a guaranteed completion date.

Turnaround times depend on the scope of the project and may be affected by Client response times, amendment rounds, approvals, additional requests, third-party services and circumstances outside our reasonable control.

If the Client has a fixed launch date, event, print deadline or other time-sensitive requirement, this must be disclosed before booking so The Dream Design Studio can determine whether it can reasonably be accommodated.

Unless confidentiality has been agreed in writing beforehand, The Dream Design Studio reserves the right to display completed work for promotional purposes, including on our website, Hopp page, social media channels, portfolio and marketing materials.

Where appropriate, The Dream Design Studio may identify or tag the Client’s business when showcasing completed work.

If a project needs to remain confidential until a particular launch date, the Client must notify The Dream Design Studio before the project begins.

Where appropriate to the agreed creative direction, The Dream Design Studio may incorporate illustrative, pictorial or icon-based elements into a logo design.

These elements may be created using a variety of creative tools and processes, which may include generative artificial intelligence tools such as Midjourney, before being adapted, redrawn, vectorised, traced or otherwise developed as part of the final design.

The use of imagery, including AI-generated or AI-assisted elements, may affect whether an element or overall logo is eligible for intellectual property protection or trademark registration, and may affect the scope of any protection available.

If the Client intends to apply to register their logo as a trademark, they must inform The Dream Design Studio before the project begins. Where we have been informed of this intention in advance, we will avoid the use of image-based elements within the logo design where appropriate and will take the intended trademark application into consideration during the design process.

The Dream Design Studio does not provide legal or trademark advice and does not guarantee that any business name, logo, brand identity or other design will be accepted or successfully registered as a trademark.

It is the Client’s responsibility to carry out any necessary trademark, company name, domain name or other availability searches and to obtain independent professional advice where required before adopting or seeking to register a brand identity.

The Dream Design Studio will not be responsible for a trademark application being refused, opposed, challenged or otherwise unsuccessful, as trademark decisions and registration requirements are outside the Studio’s control.

Nothing within these Terms excludes or limits liability where doing so would be unlawful.

To the extent permitted by law, The Dream Design Studio will not be liable for indirect or consequential losses, loss of profit, loss of revenue, loss of business, loss of opportunity or losses resulting from circumstances outside our reasonable control.

The Client remains responsible for decisions made in relation to their business and for ensuring that the final work is suitable for its intended use.

The Dream Design Studio will not be responsible for delays or failure to perform its obligations where this results from circumstances outside our reasonable control.

This may include serious illness, emergencies, technical failures, disruption to third-party services, postal or courier disruption, natural disasters or other unforeseen circumstances.

Where this occurs, The Dream Design Studio will make reasonable efforts to communicate with affected Clients and resume work as soon as reasonably possible.

The Dream Design Studio may update these Terms & Conditions from time to time.

The version applicable to a project will generally be the version in effect at the time the Client books, unless otherwise required by law or agreed in writing.

These Terms & Conditions and any dispute or claim arising from them are governed by the laws of England and Wales.

Nothing within these Terms excludes any rights or remedies that cannot lawfully be excluded.
